Hereinafter referred to as: 'the artist'; ‘she/her’ or 'Heidi Linck'

to: anyone who purchases a work made by Heidi Linck directly from her, as a private individual or as a business customer, hereinafter referred to as: 'the customer' or ‘they/them’.

These general terms and conditions do not apply to the delivery of commissioned art. Other general terms and conditions apply to commissioned art, which are included with each proposal.

Article 1: Basics

1.1 The artist reserves the right to adjust her prices, hourly rates and general terms and conditions without prior notice. Whenever a supply agreement is concluded, the prices, rates and conditions that form part of that agreement at that time are valid for that delivery.

1.2 The customer is responsible for correctly providing their invoice and delivery details.

1.3 Dutch law applies to the General Terms and Conditions of Atelier Heidi Linck. If it contains a condition that conflicts with this right, the other conditions remain valid.

Article 2: General terms and conditions when purchasing a work of art from and through Atelier Heidi Linck

2.1 Application: These conditions apply when a work of art made by the artist is purchased directly from her in her studio, at an exhibition or via her website www.heidilinck.nl. Direct sales is defined as sales in which the invoice is paid in whole or in part by the customer directly to the artist without the intervention of an intermediary party.

2.2 Prices: Prices of works of art include VAT and exclude shipping costs.

2.3 Delivery agreement: Customers have the option to view a work without obligation in Heidi Linck's studio and then decide whether or not to purchase. Customers can also order a work by e-mail without any preview. The total price will be communicated to the customer by invoice, together with these general terms and conditions and expected delivery time. If the customer pays in full within 48 hours, these general terms and conditions are automatically accepted by the customer and the delivery agreement is confirmed by the artist. The delivery time after payment of the invoice within the Netherlands is a maximum of 3 weeks, unless force majeure. A work can be collected in the studio by appointment. Payment is made via online banking on the basis of the invoice. No cash is accepted in the studio.

2.4 Framing: Drawings are supplied without a frame or framed by the artist in a Bart 1125 interchangeable frame, equipped with anti-reflective museum glass AR70 and frame spacer profiles. If desired, the artist can refer the client to professional companies for the conservation framing of drawings. Photo prints are finished and framed by a professional photo lab where the photo is glued behind anti-reflection acrylic. Photo prints are also available without finishing ('print only') and can then be framed by the customer according to his or her own wishes.

2.5 Shipping: Shipping costs are calculated based on customer wishes. Unframed work up to 70 x 70 cm is shipped free of charge within the EU. Due to the fragility of the glass, framed works are not shipped, but are collected by the customer from Heidi Linck's studio or delivered to the customer by an art handler on request. When shipping work outside the EU, any import duties and customs clearance costs are borne by the customer.

2.6 Returning policy: Customers have a reflection period of 14 days after delivery of the artwork. If the customer changes their mind, the customer can cancel the purchase by sending an email to the above email address. The customer will then receive instructions for returning or returning the work to the artist's studio. The costs for returning or returning are borne by the customer. Work that is damaged and for which the damage has not been reported within 24 hours of delivery can not be returned.

2.7 Warranty: The artist produces her drawings on professional, acid-free drawing paper of archival quality and with the most lightfast inks and pigments. When framing she uses materials that do not affect the work. Photo prints are carried out by a Dutch company specialized in printing and finishing according to museum standards. However, the artist limits the warranty on the condition of her work to 2 years after delivery to the customer. She advises to remove the purchased work from the packaging immediately after delivery and store it in an acid-free box if the work is not framed. She also advises never to place the work outside, nor in direct sunlight, nor above a heating source, nor in a damp room, nor without a preservative frame or preservative packaging. Framed work must be hung according to the instructions provided. Framed work should only be cleaned with a scratch-free cloth and agents based on water and alcohol and free from other solvents, oil, soap and ammonia. At the customer's request, the artist can refer to suitable cleaning products. The warranty expires immediately if the above advice is not followed temporarily or permanently. Framing services supplied by a third party requested by the customer is subject to the warranty conditions of that third party.

2.8 Transfer of risk: The work is packaged in the studio in such a way that it is virtually impossible for folds, tears, moisture, holes or stains to occur during transport or shipment. The risk of damage to the work is immediately transferred to the customer upon delivery to the studio. When delivering by shipping, the risk lies with Heidi Linck and the delivery service she engages until the moment of delivery to the customer. When delivering by shipping, the customer is obliged to report damage to the packaging and possibly to the work itself within 24 hours of delivery, including photos, so that the delivery service can be held liable. If the customer fails to do this, the work will be deemed to have been delivered free of damage.

2.9 Authenticity: Each work by Heidi Linck is signed in pencil on the front and/or back and numbered in the case of edition. A certificate of authenticity is available free of charge upon request.

2.10 Complaints: Complaints, but also compliments, can be addressed to the above email address.

Last adjustment of these General Terms and Conditions: March 20, 2024.
